Terms of Use

These Terms of Use ("Terms") govern your access to and use of the wispen.ai desktop application for macOS and the website at wispen.ai (together, the "Service"), operated by Vibes LLC ("wispen", "we", "us" or "our").

By downloading, installing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

The Service is provided by Vibes LLC, a company registered in the State of Wyoming, USA, with its address at 30 N Gould Str, Suite R, Sheridan, WY, 82801. You can reach us at support@wispen.ai.

2. What wispen is

wispen is a voice dictation app for macOS. You hold a key, speak, and wispen transcribes your speech into text and places it where your cursor is, in whatever application you are using. Speech recognition runs on your own Mac using an on-device model; how this works in relation to your data is described in our Privacy Policy.

3. License to use the app

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use wispen on Mac computers you own or control, for your own purposes, including work and commercial use.

You may not, except to the extent applicable law expressly permits: copy, redistribute, sell, rent, sublicense or otherwise make the app available to others; reverse engineer, decompile or disassemble the app; remove or alter any proprietary notices; or use the app to build a competing product.

4. Permissions the app needs

To function, wispen asks for certain macOS permissions:

Microphone — to capture your speech while you hold the dictation key.
Accessibility — to detect the dictation key globally and to paste the recognized text into the app you are using.

You can grant or revoke these permissions at any time in macOS System Settings. Revoking them will stop the relevant functionality from working.

5. Acceptable use

You agree to use the Service only for lawful purposes and not to: use it in any way that violates applicable laws or the rights of others; attempt to interfere with, disrupt or gain unauthorized access to the Service or related systems; or use the Service to create content that is unlawful, harmful or infringing. You are responsible for the text you produce with wispen and for how you use it.

6. Intellectual property

The app, the website, our name, logo and all related materials are owned by Vibes LLC or its licensors and are protected by copyright, trademark and other laws of the United States, the State of Wyoming and other jurisdictions. These Terms do not grant you any rights in our intellectual property except the limited license in Section 3.

The text you dictate is yours. We claim no ownership over it, and — because transcription happens on your device — we do not receive or store it (see the Privacy Policy).

7. Third-party and open-source components

wispen relies on third-party and open-source software, including the WhisperKit speech-recognition framework and the underlying speech model. These components are provided under their own licenses, and your use of them is subject to those licenses. On first launch, the app downloads the speech model from its provider so that recognition can run locally afterward. We are not responsible for third-party software or services beyond integrating them in good faith.

8. The app is free; changes to the Service

wispen is currently provided free of charge. We may, at our discretion, update, change, suspend or discontinue any part of the Service, introduce new features, or — should we ever do so in future — introduce paid features, in each case with notice where required by law. We may release updates to improve or maintain the app, and recommend you keep it up to date.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Speech recognition is inherently imperfect. We do not warrant that transcription will be accurate, complete or error-free, and you are responsible for reviewing the text wispen produces before relying on or sending it. You use the Service at your own risk.

10. Limitation of liability

To the fullest extent permitted by law, Vibes LLC and its officers, directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of, or inability to use, the Service. To the extent liability cannot be excluded, our total liability to you for all claims will not exceed USD 10.00. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold Vibes LLC harmless from any claims, damages, losses and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Governing law

These Terms are governed by the laws of the United States and the State of Wyoming, without regard to conflict-of-law principles. If any provision is found unenforceable, the remaining provisions stay in effect.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and update the effective date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
